The new Capital gains tax on 10% on financial assets (including investment gold such as gold coins and gold bars) is on April 21, 2026 Officially published in the Belgian Official Gazette. The associated law, the Law on the introduction of a tax on capital gains from financial assets, has become definitively effective retroactively from January 1, 2026.
    • You pay 10% tax regarding the realized net capital gains on sale. 
    • There is an exemption from €10,000 profit per calendar year per taxpayer. Only if your total gain on financial assets in a single year exceeds this amount will you pay 10% on the portion above that amount.
    • If you do not sell gold in a calendar year or if the total profit remains below €10,000, the remaining part of your exemption expires on December 31 of that year. You always start with a clean slate on January 1st of the new year and a fixed exemption of exactly €10,000 for that new year. So it's not possible to suddenly cash in €40,000 in tax-free profit in the fourth year, for example, after three years without sales.
    • Only the added value that has been built up from January 1, 2026 is taxed. The reference value for the calculation is the determined value on December 31, 2025. Profits made before that date remain fully tax-free.
    • For physical gold, you must consider the taxable capital gain to indicate yourself through the annual personal income tax.
    • During a tax audit, you must be able to prove when you acquired the gold and at what value. The tax authorities place the entire burden of proof on you. If you fail to do so, you risk the tax authorities full retail price considers it pure profit and imposes a 10% tax on it.
      How you prove this depends on when you acquired the gold:

      1. Gold purchased from January 1, 2026

      For new purchases, it's very simple: the original purchase invoice or receipt from your gold dealer serves as legal proof of purchase. Therefore, keep these documents carefully. They will state the exact purchase price needed to calculate the net capital gain upon subsequent sale.

      2. Gold owned before January 1, 2026

      Since historical profits prior to 2026 are exempt, you must prove that you were already in possession of the gold by December 31, 2025. If successful, the official gold price on December 31, 2025, will serve as your tax “purchase price.”.
      The FOD Finance accepts various alternative means of proof for this:
      • Proof of purchase: Old invoices or bank statements from the original purchase (even if it was years ago).
      • Timestamped photos: Photos of your gold bars with serial numbers or coins next to a newspaper from before the end of December 2025.
      • Official certificates: An inventory or safe deposit box certificate from a bank or external gold storage, dated around the turn of the year.
      • Bailiff: An official report of findings drawn up before 2026.
      • Inheritance or gift: A registered deed of gift or an old inheritance tax return.

      What if you really have no proof?

      If you sell old gold—for example, gold you bought with cash or received as a gift—without any documentation, and you cannot prove that you owned it before 2026, you will not be able to use the reference value as of December 31, 2025. In that case, the tax authorities will apply the tax fiction that the purchase price was €0. You will then pay 10% tax on the Total sales amount to the extent that you exceed the annual exemption of €10,000.

What is tax-exempt?

  • No capital gains tax applies to silver and platinum if VAT was already charged at the time of purchase.

No. When selling physical gold, a recognized gold buyer does not automatically withhold taxes. You will receive the full amount net in your account. As the seller, you are responsible for spontaneously declaring any taxable capital gains (above the exemption) in your annual Belgian tax return. Therefore, always keep your purchase and sale invoices carefully.

For investment gold (such as gold bars with a purity of at least 99.5% and certified gold coins with a purity of 90% or higher), you pay 0% VAT in Belgium. This is legally exempt under European directives.
